What happens after a driver/rider has been found positive for driving/riding under the influence of alcohol, drug or any other intoxicating substances in Mauritius?

New Legal Limits in Mauritius
•20 milligrammes of alcohol in 100 ml of blood.
•27 milligrammes of alcohol in 100 ml of urine.
•9 microgrammes of alcohol in 100 ml of breath.
If you refuse to undergo a field impairment test (drug) or any of the 3 tests above, the following applies by default:
Failing to submit breath test (123F RTA) and Failing to give specimen for analysis (123H RTA) constitute a Prima Facie case of driving under the influence of alcohol above precribed limits.
You will be prosecuted nonetheless.
Drug Driving in Mauritius
Drug Driving is considered a very serious offence and is now detectable and punishable by law (The Road Traffic (Amendment) Act 2019).
In Mauritius, being in possesion of any quantity of drugs is an illegal act. Driving while under the influence of drug (except doctor prescribed pharmaceutical drugs in legal limits) is doubly punishable. The fine is Rs 75 000 and an imprisonment term not exceeding 8 years.
Penalties on First Conviction:
1. Fine not less than Rs 20,000 and not more than Rs 50,000
2. Imprisonment not more than 5 years.
3. Disqualification of driving licence (you may get a part disqualification - consult main page) for a minimum period of 12 months.
Penalties on Second and Subsequent Conviction:
1. Fine not less than Rs 50,000 and not more than Rs 75,000.
2. Imprisonment not less than 12 months and not more than 8 years.
